Buttrr Social Terms of Service

Effective Date: September 23, 2026

These Terms of Service ("Terms") are a legal agreement between you and Friendly Ventures LLC, doing business as Buttrr Social ("Buttrr Social," "Company," "we," "us," or "our") regarding your use of the Buttrr Social web app (the "Service"). By creating an account or using Buttrr Social, you agree to these Terms and our Privacy Policy.

Important: These Terms contain a binding arbitration clause and class action waiver that affect your legal rights. Please read them carefully.

THE "DISPUTE RESOLUTION" SECTION OF THESE TERMS REQUIRES, WITH LIMITED EXCEPTIONS, THAT DISPUTES BETWEEN YOU AND US BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION UNLESS YOU OPT OUT. YOU AND WE MAY ONLY PURSUE CLAIMS ON AN INDIVIDUAL BASIS, NOT IN ANY CLASS OR REPRESENTATIVE PROCEEDING.

Buttrr Social is built by and for the LGBTQ+ community to help gay men meet and connect, for dating, friendship, and community.

Our mission: a safe, authentic place for gay men to find each other.
Our values: respect, authenticity, safety, and genuine connection.

Who Can Use Buttrr Social

Age Requirement

You must be 18 years or older to use Buttrr Social.

By accepting these Terms and creating an account, you represent and warrant that:

You are 18 years of age or older.
You can lawfully enter into this agreement.
You are not located in a country subject to a U.S. government embargo, and you are not on any U.S. government list of prohibited parties.

We ask for your date of birth when you sign up. It is used only to confirm you are 18 or older and is never shown to other members. A date of birth under 18 is refused, and the Service cannot be used. Providing a false date of birth is grounds for immediate and permanent termination, with no appeal.

Where the Service Is Available

Buttrr Social is available in the United States. At launch, we are focusing on the Chicago, Illinois area, and we may open other areas over time.

Account Requirements

One account per person. Multiple accounts are prohibited.
Real identity. Fake profiles and impersonation are removed.
A working mobile phone number, used to sign in and secure your account.
Compliance with our Community Guidelines.

CRITICAL SAFETY WARNINGS

No Background Checks or Identity Verification

BUTTR SOCIAL DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS, SEX OFFENDER SEARCHES, OR OTHER IDENTITY VERIFICATION OF MEMBERS. WE MAKE NO REPRESENTATIONS OR WARRANTIES ABOUT THE CONDUCT, IDENTITY, INTENTIONS, LEGITIMACY, OR TRUTHFULNESS OF ANY MEMBER.

You are solely responsible for:

Your interactions with other members, on or off the Service.
Verifying the identity of anyone you choose to meet.
Your personal safety when meeting anyone in person.
The consequences of your interactions with other members.

Location Privacy Warning

The Service shows other members an approximate distance to you. To protect you, we never store your exact position: your location is rounded to an area roughly half a kilometre across before it is saved, and distances are shown in half-mile steps. Your neighborhood is only shown if you choose it yourself.

EVEN SO, A DETERMINED PERSON MAY BE ABLE TO ESTIMATE WHERE YOU ARE by comparing distances over time or from different places. If that concerns you, do not share your location, and do not choose a neighborhood.

The Service is for personal use only. It is not an emergency or safety service. Do not use it while driving.

Content and Member Responsibility

You may encounter content that some people find objectionable. We are not responsible for:

Content posted by other members.
The accuracy of information members provide, including health status, physical descriptions, or anything else on a profile.
Legal consequences of using the Service in places that restrict LGBTQ+ activity.

Account Registration and Security

Creating Your Account

Phone verification: you provide a U.S. mobile number and enter the code we text you.
Age confirmation: you enter your date of birth.
Agreement: you accept these Terms, the Privacy Policy, and the Community Guidelines.
Membership: you choose a plan and pay. There is no free tier.

Account Security

There is no password. Anyone with access to your phone number's text messages can sign in as you. Keep your phone secure, and tell us at hello@buttrr.com immediately if you believe someone else has used your account.

Data Storage and Backup

WE HAVE NO OBLIGATION TO RETAIN YOUR ACCOUNT DATA BEYOND WHAT THE PRIVACY POLICY DESCRIBES. Messages expire and are deleted on the schedule set out there. You are responsible for keeping any contact details or conversations you want to keep.

Community Guidelines and Acceptable Use

Respectful Behavior

Treat others with respect. Harassment, bullying, and discrimination are prohibited.
Consent matters. Respect others' boundaries and preferences.
No hate speech. Content promoting hatred based on identity is not allowed.
Authentic profiles. Use real photos of yourself and accurate information.

Prohibited Content and Behavior

Content violations:

Nudity or sexually explicit content in public profile photos.
Violent, threatening, or illegal content.
Spam, promotional content, or unauthorized solicitation.
Content promoting self-harm or dangerous activities.
Copyrighted material you do not have the right to use.
Any content depicting minors, in any context.
Obscene, offensive, or discriminatory material.

Behavioral violations:

Harassment, stalking, or threatening other members.
Sharing private conversations or private photos without consent.
Creating fake profiles or impersonating others.
Soliciting money, goods, or services.
Using the Service for illegal activity.
Collecting or storing personal information about other members.
Violating others' privacy or intellectual property rights.
Creating a new account to get around a block or a ban.

Automation restrictions. You will not use Buttrr Social, member content, or Service data to train, develop, or improve artificial intelligence or machine learning systems; to develop a competing product; or to build bots or automated tools that interact with the Service.

Your Content and Privacy

Content Ownership and License

You own the content you post to Buttrr Social.

By posting content, you grant us a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use, copy, store, modify, and display that content as necessary to operate and improve the Service, including showing your profile to other members and delivering your messages. This license ends when you delete the content or your account, except where the content has already been shared with other members or must be retained under the Privacy Policy or applicable law. We will not use your content in marketing without your consent.

Content Moderation

We reserve the right to:

Screen public profile photos and profile headlines with automated moderation tools, and reject content that fails screening.
Review reported content and messages for safety and compliance.
Remove any content that violates these Terms or the Community Guidelines.
Suspend or terminate accounts for violations.
Report illegal content to the appropriate authorities.

Private Photos

Private photos are never shown to anyone automatically.
You choose, one photo at a time, to send a private photo to a member in a conversation.
Nobody can request access to your private photos, and nobody gets access to all of them.
A member who receives a photo may save or screenshot it. Send only what you are comfortable with.

Messages

Messages, including voice messages and shared photos, phone numbers, and locations, are private between you and the recipient.
We may review reported messages for safety.
Messages expire 90 days after they are sent and are permanently deleted 180 days after they are sent, as described in the Privacy Policy.
Deleting a conversation deletes it for both people.

Membership and Payments

Membership

Buttrr Social is a paid membership. You choose a plan when you sign up, and your membership must be active to browse profiles and send messages.

Plans at launch:

Monthly: $7.95, billed every month.
6 Months: $42.95, billed every 6 months.
Annual: $75.95, billed every 12 months.

Prices are in U.S. dollars and may not include taxes.

Automatic Renewal

AUTOMATIC RENEWAL: YOUR MEMBERSHIP RENEWS AUTOMATICALLY AT THE END OF EACH BILLING PERIOD, AND THE CARD ON FILE IS CHARGED THE PLAN PRICE, UNTIL YOU CANCEL. CANCEL BEFORE THE RENEWAL DATE TO AVOID THE NEXT CHARGE.

Payments are processed by Braintree, a PayPal service. Your card details are entered into and stored by Braintree; we never see or store your card number.

Cancellation

You can cancel at any time in Settings → Membership. Cancellation takes effect at the end of the period you have already paid for: you keep access until then, and you are not charged again. You can undo a cancellation before that date. Deleting your account cancels your membership immediately.

Changing Plans

You can switch plans in Settings → Membership. The new plan starts on your next renewal date at the new price; there are no partial charges or credits for the current period.

Refunds

If you're not happy with your membership, email hello@buttrr.com and we'll refund your most recent membership payment in full. A refund ends your membership when it's issued. Cancelling, changing plans, or deleting your account does not issue a refund on its own. Accounts we terminate for violating these Terms are not refunded. See the Refund Policy for details.

Price Changes

We may change prices for future billing periods. If we change the price of your plan, we will give you at least 30 days' notice by text message or in the Service before it takes effect, and you may cancel before then.

Safety and Reporting

Report members or content using the report tools in the Service or by emailing hello@buttrr.com.
Block a member to stop all contact. A blocked member cannot see your profile or message you, and you cannot see theirs.
Reports are reviewed by a person. Serious violations lead to permanent bans.

Law Enforcement

We comply with valid legal requests and court orders and may challenge requests we consider overly broad. We respond immediately to credible threats of harm. We report child exploitation to the National Center for Missing & Exploited Children and other criminal activity as required by law.

Intellectual Property

Our Rights

The Service, its name, logo, design, software, and features belong to Friendly Ventures LLC. You may not copy, modify, distribute, sell, or lease any part of the Service or reverse-engineer its software.

Your Rights

Your photos and profile information belong to you. You can delete your content at any time, and you can request a copy of your information as described in the Privacy Policy.

Copyright (DMCA)

If you believe content on Buttrr Social infringes your copyright, send a written notice to:

Your notice must include: your physical or electronic signature; identification of the copyrighted work; identification of the infringing material and where it appears on the Service; your contact information; a good-faith statement that the use is not authorized; and a statement, under penalty of perjury, that the notice is accurate and you are authorized to act. Accounts that repeatedly infringe are terminated.

Service Changes and Availability

We may modify, add, or discontinue features at any time. We will give members at least 30 days' notice of material changes that affect paid membership; changes for safety or legal reasons may take effect immediately.

The Service is provided "as is" without uptime guarantees, may be unavailable during maintenance, and may not work in every browser.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free; that defects will be corrected; that member information is accurate; or that using the Service will lead to any relationship or connection.

We are not responsible for the conduct of any member, on or off the Service.

Health Information

Members may choose to show health information such as HIV status and vaccination status on their profiles. This information is entered by the member, is not verified by us, and is not medical advice. Always consult a healthcare provider for health decisions.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BUTTRR LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR YOUR INTERACTIONS WITH OTHER MEMBERS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow these limitations; in that case they apply to the fullest extent permitted.

Indemnification

You agree to defend, indemnify, and hold harmless Friendly Ventures LLC from any claims, damages, and expenses, including reasonable attorneys' fees, arising from your content, your use of the Service, your interactions with other members, or your violation of these Terms or any law.

Dispute Resolution

Binding Arbitration

You and Friendly Ventures LLC agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except as stated below. The Federal Arbitration Act governs this agreement.

Process

Before starting arbitration, the party with a claim must send the other a written notice describing it (to us: hello@buttrr.com, or the address above) and allow 60 days to resolve it informally. Arbitration will take place in Denver, Colorado, or by video, at your choice. We will pay AAA filing and arbitrator fees for claims under $10,000 unless the arbitrator finds the claim frivolous.

Exceptions

Either party may bring an individual claim in small claims court, or seek injunctive relief in court for intellectual property infringement or unauthorized access to the Service.

Class Action Waiver

YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

Opt-Out

You may opt out of this arbitration agreement by emailing hello@buttrr.com within 30 days of creating your account, stating your phone number and that you opt out of arbitration. Opting out does not affect any other part of these Terms.

Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules. Subject to the arbitration agreement, you and we consent to the exclusive jurisdiction of the state and federal courts located in Denver, Colorado.

Termination

By You

You can delete your account at any time in Settings. Deletion cancels your membership immediately and does not issue a refund on its own (see the Refund Policy to request one first), and removes your profile, photos, and messages as described in the Privacy Policy.

By Us

We may suspend or terminate your account immediately, without refund, for: being under 18; illegal activity; threats to member safety or the Service; repeated violations of these Terms or the Community Guidelines; or payment fraud or abuse. For lesser first-time violations we may warn you first.

Effect

On termination you lose access to the Service, your profile is removed, and your messages are removed from other members' conversations. Some records are retained as described in the Privacy Policy or as required by law. Terminated members may not create new accounts. The sections on intellectual property, indemnification, limitation of liability, and dispute resolution survive termination.

LGBTQ+ Community Commitments

We work to keep Buttrr Social a welcoming place for all LGBTQ+ people.
Discrimination based on sexual orientation, gender identity, or gender expression is prohibited.
We respect your privacy about your identity and never disclose it.
We use affirming language and respect chosen names.

General

Entire agreement. These Terms, the Privacy Policy, and the Community Guidelines are the entire agreement between you and us about the Service.
Severability. If any provision is unenforceable, the rest remain in effect.
No waiver. Our failure to enforce a provision does not waive our right to enforce it later.
Assignment. We may assign these Terms; you may not assign your rights without our consent.
Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, public health emergencies, government action, internet or hosting failures, or failures of third-party services such as payment processors.
Third-party services. The Service relies on third parties, including our payment processor and hosting providers, whose own terms apply to their services.
Changes to these Terms. We will give at least 30 days' notice of material changes by text message or in the Service. Continued use after the effective date is acceptance. If you disagree, delete your account before then.

By creating an account or using Buttrr Social, you confirm that you have read and understood these Terms, agree to be bound by them including the arbitration agreement and class action waiver, are 18 or older, and accept responsibility for your safety and your interactions with other members.
